Our litigators have extensive expertise in the litigation and resolution of insurance claims and disputes.  We have acted in actions arising out of insurance company insolvencies, investment disputes, environmental damage, property damage, professional liability, products liability, commercial fraud, directors' and officers' liability, admiralty and re-insurance disputes.



Representative Transactions/Cases
  • Acted for an international life insurer in a dispute involving the redemption of its subordinated note investment in a series of mortgage-backed securities.
  • Acted for a group of life insurers and other institutional investors to challenge the proposed $52 billion takeover of BCE.
  • Represented a major Canadian insurer in respect to the Cavell "solvent scheme of arrangement".
  • Defended complex construction and engineering claims, including multiple-party product liability and personal injury claims arising from a double-fatality accident which occurred during the construction of the SkyDome in Toronto.
  • Obtained a multi-million dollar damage award on behalf of an insurer involving claims of breach of trust and fiduciary duty.
  • Successfully claimed against an agent in a multi-million dollar travel insurance claim.
  • Defended claims arising out of products liability for the insurers of manufacturers.
  • Acted for owners and contractors and their insurers in construction disputes.
  • Advised, investigated and asserted indemnity claims on behalf of insurers and defended property damage claims arising out of natural disasters, including the 1996 and 1997 Ottawa flooding cases and a major 1998 ice storm.
  • Advised on fraud matter involving an officer of a major health insurer.
